Terms of Service
Welcome to 305 Northwest. These Terms of Service (“Terms”) govern your use of our services. By engaging our services, you agree to be bound by these Terms.
1. Scope of Services
We provide a range of production services, including but not limited to planning, filming, post-production, photography, and marketing asset creation. The specific services to be provided will be detailed in a separate Scope of Work (SOW) document.
2. Project Timeline and Deadlines
The timeline for each project will be outlined in the SOW. We strive to meet all deadlines but are not responsible for delays caused by factors beyond our control, including but not limited to weather conditions, client delays, or unforeseen technical issues.
3. Payment Terms
A non-refundable deposit of 50% of the total project cost is required to secure our services. The remaining balance is due 24 hours prior to the scheduled shoot date. Additional expenses incurred during the project will be billed separately and are due upon receipt of the invoice.
4. Revisions and Additional Charges
Please be advised that after three rounds of complimentary changes, any further requested updates will be billed at a rate of $50 per hour. By proceeding with additional revisions beyond the included three rounds, you agree to these terms and the associated charges.
5. Client Acknowledgement
By requesting additional changes beyond the three complimentary rounds, I acknowledge and agree to the hourly billing rate of $50 for each hour of additional work.
6. Intellectual Property
All original content created by 305 Northwest remains the intellectual property of the company until full payment has been received. Upon full payment, ownership rights will be transferred to the client.
7. Confidentiality
We understand the importance of confidentiality. Any proprietary information shared with us during the course of the project will be kept confidential and will not be disclosed to any third parties without prior consent.
8. Liability
305 Northwest is not liable for any indirect, incidental, or consequential damages arising out of or in connection with the services provided. Our total liability shall not exceed the total amount paid for the services.
9. Cancellation Policy
Cancellations must be made in writing at least 14 days prior to the scheduled shoot date. The deposit is non-refundable. Cancellations made less than 14 days prior to the shoot date will be subject to additional charges.
11. Other Legal Policies
By agreeing to these terms, you also agree to our other legal policies, including our Privacy Policy and Refund Policy, which are available on our website.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of Tampa, Florida without regard to its conflict of law principles.
